Building Control Regulations, 2009

These new regulations are cited as the Building Control (Amendment) Regulations 2009 and they came into effect on the 1st October 2009. Provisions of article 8 (Disabled Access Certificate) came into effect on the 1st of January 2010.

What is a Disability Access Certificate?

A Disability Access Certificate is a certificate of compliance issued by the Building Control Authority with respect to requirements under Part M of the Building Regulations.

An application for a DAC shall be required in respect of all works or a building to which a Fire safety certificate is required. No works may commence without a valid Disability Access Certificate.

An application for a disability access certificate shall be accompanied by:

  • such plans, (including a site or layout plan) (in duplicate) and such other particulars as are necessary to
    1. identify and describe the works or building to which the application relates,
    2. enable the building control authority to assess, whether the said works or building would, if constructed in accordance with the said plans and other particulars, comply with the requirements of Part M of the Second Schedule to the Building Regulations,
    3. identify the nature and extent of the proposed use and, where appropriate, of the existing use of the building concerned
  • appropriate application fee

What is a Revised Disability Access Certificate?

A Revised Disability Access Certificate shall be required where significant revision is made to the design or works of a building or an extension of, a material alteration to or a material change of use of a building in respect of which a disability access certificate has been granted by a building control authority.

An application for a Revised Disability Access Certificate shall be on the appropriate form and accompanied by:

  1. such revised plans, (including a site or layout plan)(in duplicate) and such other revised particulars as are necessary to
    1. identify and describe the works or building to which the application relates,
    2. enable the building control authority to assess, whether the said works or building would, if constructed in accordance with the said plans and other particulars, comply with the requirements of Part M of the Second Schedule to the Building Regulations,
    3. identify the nature and extent of the proposed use and, where appropriate, of the existing use of the building concerned, and
  2. Appropriate application fee.

How much does a Disability / Revised Access Certificate cost?

With the exception of certain specified schools, the fee for a disability/revised access certificate shall be €800 per building.

In order to facilitate the efficient and effective processing of Disability Access Certificates , please arrange to submit to Building Control authority at the same time as submission of Fire Certificate Process.
